These Terms and Conditions apply to your use of the Loanza® (“Loanza”, “we”, “us”, “our”) website and its loan connection service (hereinafter the “Service”). By accessing or using this Service, you agree to be bound by these Terms and Conditions.

Services and Products on Offer

Loanza is not a lender and is not responsible for any credit decisions that may be made about you or any lending product that may be offered to you. Loan offers are provided solely by independent, third-party lenders. Any additional services or products available through this Service are offered by and remain the sole responsibility of any respective product vendors and/or service providers.

Submitting your information does not guarantee loan approval or that you will be connected with a lender, nor receive the full loan amount requested. You are under no obligation to accept a loan offer once you are connected with a lender.

Loan Request Policy

Loanza reserves the right to reject your request for any reason not prohibited by law. Additional information or verification may be required before your form is accepted.

When you submit your information through our Service, you will be connected with a lender or lending partner based on their policies and procedures for further consideration. This does not mean your loan has been approved.

Loanza is not responsible for taking, approving or denying your loan request. Loan approval is solely the lender’s or lending partner’s decision.

You agree that if we cannot find a lender or lending partner that can offer you the type of loan you requested, we may attempt to connect you with other lending partners offering alternative loan products.

E-sign Consent

You agree that clicking “Submit Loan Request” (or another button that submits your form) acts as your electronic signature. You authorize Loanza and any affiliated lenders or partners to communicate with you electronically, including required disclosures (e.g., notices of adverse action). You confirm that you have the ability to access documents electronically, including the ability to view and save PDF files.

Credit Authorization

You authorize Loanza and its partners to:

  • Obtain your credit and consumer information from credit bureaus (e.g., TransUnion, Experian, Equifax).
  • Use your information for identity verification and debt-to-income analysis.
  • Share your information with lenders or service providers for credit decisions and prequalification.

Eligibility and Restrictions

To submit a loan request through our Service, you must be:

  • At least 18 years of age
  • A legal resident of the United States

You agree not to use this Service for any unlawful or unauthorized purpose.

Service Use

Loanza does not charge you to use this Service. We are not acting as an agent for (1) you, (2) any lender or lending partner or (3) any supplier or vendor used in the evaluation of your loan inquiry or other use of this Service. We may receive compensation from lenders or lending partners and other third parties for the services we provide to them, related or not to the Service we provided to you.

Email Marketing

By providing your email address, you consent to receive both transactional and promotional emails from Loanza, lenders and lender networks, affiliates and other third parties.

SMS Marketing

By submitting your information on this Service, you are voluntarily opting-in to mobile marketing. You expressly consent to receive SMS marketing messages from Loanza, affiliates, and third-party partners. You understand and agree that message and data rates may apply (based on your individual carrier and plan), and you are solely responsible for these charges.

You understand and agree that:

  • By expressly authorizing and willingly requesting Loanza, affiliates, and third-party partners to send you SMS Messages, you waive your right to file a claim with the FTC, FCC, or any other federal or state agency with regard to such contact.
  • Opting-in to SMS marketing with Loanza, affiliates, and third-party partners overrides all corporate, state, or federal Do-Not-Contact registry listings.
  • You can opt out of receiving SMS messages from each individual sender by following instructions provided in any SMS message. All requests to unsubscribe from SMS Messages from Loanza are added to our Do-Not-Contact list within ten (10) days of receipt.
  • Unsubscribing from Loanza SMS marketing does not unsubscribe you from third parties. You must contact them directly.
  • If you resubmit your information, you consent to resume receiving messages from Loanza, affiliates, and third-party partners.

You confirm that you are at least 18 years old and authorized to use the mobile number you provided to us and approve any applicable charges.

Compliance with Laws

You agree to comply with all applicable laws, statutes, ordinances and regulations regarding your use of this Service and any third-party products or services accessed through it.

We reserve the right to:

  • Investigate any potential violations of our Terms and Conditions and Privacy Policy
  • Suspend or terminate customer access during investigations
  • Delete data from our servers to minimize further violations
  • Report actual or perceived violations of law to law enforcement or other authorities

You agree to cooperate fully with any such investigation. You acknowledge that violating the Terms and Conditions or Privacy Policy could subject you to criminal or civil penalties.

Intellectual Property

All content on this website—trademarks, graphics, text, software, images—is the property of Loanza or its licensors. You may view and print content for personal use only in connection with submitting a loan request. You may not reproduce, distribute, or display content without written permission.

Limitation of Liabilities and Warranties

THIS SERVICE AND THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES ASSOCIATED WITH IT ARE PROVIDED “AS IS”. Loanza MAKES NO EXPRESS OR IMPLIED WARRANTIES OF ANY KIND REGARDING THIS SERVICE OR ANY ASSOCIATED CONTENT, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.

Loanza DOES NOT GUARANTEE ANY SPECIFIC RESULTS FROM THE USE OF THIS SERVICE OR THE INFORMATION, SOFTWARE, PRODUCTS, OR SERVICES PROVIDED. YOUR USE OF THIS SERVICE IS AT YOUR SOLE RISK.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Loanza, ITS PARTICIPATING LENDERS, ADVERTISERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUBSIDIARIES, SUCCESSORS, ASSIGNS, CONTENT PROVIDERS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES OR OTHER LOSSES ARISING OUT OF OR RELATED TO:

  • YOUR ACCESS TO OR USE OF THIS SERVICE AND/OR Loanza SERVICES
  • ANY DELAY OR INABILITY TO ACCESS OR USE THIS SERVICE;
  • ANY INFORMATION, SOFTWARE, PRODUCTS AND SERVICES OBTAINED THROUGH THIS SERVICE, OR OTHERWISE ARISING OUT OF THE USE OF THIS SERVICE
  • ANY OTHER USE OF THIS SERVICE

WHETHER RESULTING IN WHOLE OR IN PART, FROM BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF Loanza OR ITS PARTICIPATING LENDERS HAVE BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.

SOME STATES DO NOT ALLOW THE LIMITATION OF LIABILITY AND DISCLAIMER OF IMPLIED WARRANTIES, SO THE DISCLAIMERS AND LIMITATIONS ABOVE MAY NOT APPLY TO YOU. IN SUCH STATES, THE RESPECTIVE LIABILITY OF Loanza, ITS PARTICIPATING LENDERS, AND THEIR OFFICERS, DIRECTORS, AGENTS, SUBSIDIARIES, AFFILIATES, EMPLOYEES, SUCCESSORS, ASSIGNS, CONTENT PROVIDERS AND SERVICE PROVIDERS IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

Indemnity

As a condition of your use of this Service, you agree to indemnify and hold harmless Loanza, its affiliates, employees, service providers, and partners that provide services in the operation of this Service, from and against any and all claims, damages, liabilities, losses, costs or expenses (including attorneys’ fees) arising out of, relating to or resulting from your use or attempted use of this Service or your violation of these Terms and Conditions.

This website may include links to third-party websites. Loanza is not responsible for the content, policies, or practices of these sites, and does not endorse or recommend them or their products and services offered.

Privacy

Your use of this Service is subject to the Loanza Privacy Policy, which is incorporated by reference. The Privacy Policy sets out your rights and our responsibilities regarding your personal information. We reserve the right to modify our Privacy Policy at any time without notice. Continued use of the Service constitutes acceptance of any changes.

Security

While we use industry-standard technology and security protocols to protect your personal information, we cannot guarantee, and you should not expect, that your personal information, searches or other communications will always remain secure and will not be intercepted or decrypted by others. Disputes and Legal Terms

Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Delaware, without regard to its conflict of law principles. You agree that any dispute or legal action related to these Terms and Conditions, Privacy Policy, or Service provided shall be resolved in accordance with this governing law.

Binding Arbitration

You agree to resolve any dispute you may have concerning any aspect of these Terms and Conditions or the Service through binding arbitration with the American Arbitration Association (AAA) in your county of residence by filing a Demand for Arbitration. The arbitrator has the exclusive authority to resolve any dispute and decide all issues, including validity or enforceability of these Terms and Conditions. The decision of the arbitrator will be final and binding on all parties.

In any arbitration or legal proceeding permitted under these Terms and Conditions, the prevailing party shall be entitled to recover the cost of arbitration, travel expenses, expert testimony, travel expenses of experts, and all other expenses reasonably incurred in bringing or defending an arbitration claim, from the other party unless otherwise prohibited by law.

Class Action Waiver

To the fullest extent permitted by law, you agree that any legal proceeding shall be conducted solely on an individual basis and not as a class, consolidated, representative, or mass action.

You expressly waive any right to file or participate in a class action, mass arbitration, or any joint claim with other users against Loanza, its affiliates, service providers, participating lenders, or any related parties.

These Terms and Conditions do not constitute a waiver of any of your rights and remedies to pursue a claim individually and not as a class action in binding arbitration as provided above. This provision preventing you from bringing, joining or participating in class action lawsuits is an independent agreement. You may opt-out of these Dispute Resolution Provisions by providing written notice of your decision within thirty (30) days of the date that you first access or use this service.

Regardless of your opt-out decision:

YOU ACKNOWLEDGE AND AGREE THAT, VIA YOUR ACCEPTANCE OF THESE DISPUTE RESOLUTION PROVISIONS, YOU WAIVE ANY RIGHT TO:

  • A JURY TRIAL,
  • BRING, JOIN OR PARTICIPATE AS A PLAINTIFF OR A CLASS MEMBER IN A CLASS ACTION SUIT OR MULTI-PARTY ARBITRATION BROUGHT AGAINST US, ANY PERSON RELATED TO US OR A SERVICE PROVIDER USED BY US TO PROVIDE THE SERVICE.

YOU AGREE THAT YOU MAY BRING CLAIMS AGAINST US ONLY IN YOUR INDIVIDUAL CAPACITY.

No arbitration or legal proceeding may be combined with another without the prior written consent of all parties involved.

THIS CLASS ACTION WAIVER MAY BE LIMITED BY APPLICABLE LAW, BUT IS INTENDED TO BE ENFORCED TO THE FULL EXTENT ALLOWED BY LAW.

Indemnification

You agree to indemnify, defend, and hold harmless Loanza, its affiliates, officers, directors, employees, agents, and service providers from and against any claims, demands, damages, liabilities, losses, costs, or expenses (including reasonable attorneys’ fees and arbitration costs) arising out of or relating to your use or attempted use of the Service, your violation of these Terms and Conditions, or your infringement of any third-party rights.

Modifications to Terms

Loanza reserves the right to update or modify these Terms and Conditions at any time without prior notice. Your continued use of the Service after any such modification constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

Termination of Use

Loanza may, in its sole discretion and without prior notice, suspend or terminate your access to the Service at any time if we believe you have violated these Terms and Conditions, applicable law, or acted in a manner that is harmful, offensive, or inconsistent with the intent of the Service.

Important Disclosures

Not a Lender Disclaimer

Loanza is not a lender, loan broker, financial institution or an agent of a loan broker or lender. We do not participate in lending decisions or determine loan eligibility. All loan approval processes and decisions are made by independent third-party lenders.

We provide a no obligation, free of charge service introducing prospective borrowers to prospective lenders who offer loans.

Advertiser Disclosure

Loanza receives compensation from lenders and/or lending partners who, based on their scorecards, decide that a potential borrower may meet their lending conditions.This compensation is typically in the form of referral fees, and may influence which offers you are presented with.

The offer you receive may be coming from the lending partner that bid the most for your information. As a result, the offers presented may not always feature the lowest available interest rates or most favorable loan terms. Loanza does not guarantee that you will receive the best available rates or offers.

Not all lenders or financial offers available in the marketplace are included on this site. We encourage you to explore all your options and compare loan offers independently to determine the best solution for your financial needs.

Tribal Lending Disclosure

In certain cases, you may be connected to a Tribal Lending Enterprise (“TLE”), which is owned and operated by a federally recognized Native American tribe. TLEs are subject to tribal and certain federal laws, and typically claim sovereign immunity from state laws, including those that regulate interest rates and other lending terms.

  • Fees (including those for late payments, if any)
  • Conditions for refinancing, renewing, or rolling over the loan (where permitted by law)

Loan terms are determined solely by the lender or financial service provider based on their internal policies, underwriting criteria, and applicable legal regulations. Loanza does not influence or control the specific terms or conditions of any loan offer made to you.

Financial Difficulty & Late Payment Warning

Failing to make a payment or submitting a late payment may result in negative consequences, including:

  • Adverse effects on your credit score
  • Additional fees or penalties
  • Potential collection actions by the lender

We urge you to only accept loan terms that fit within your financial means. If you anticipate difficulty making a payment, contact your lender immediately to discuss your options. Responsible borrowing is essential to maintaining your financial health.

Miscellaneous

These Terms and Conditions, along with our Privacy Policy, constitute the entire agreement between you and Loanza regarding your use of this website. If any provision of these Terms is found to be unenforceable, that provision shall be severed and the remainder of the Terms shall remain in full force and effect.

Section headings are for convenience only and shall not affect interpretation. No waiver by Loanza of any right or term shall be deemed a continuing waiver of such term or any other term.

On the last step of your loan request, you see this disclaimer that you are fully agreeing to and expressly opting in for upon your form submission, which is a condensed version of our Terms and Conditions and Privacy Policy:

“By clicking the “Submit Loan Request” button, I affirm that I am at least 18 years old, that I understand, and agree to the Terms & Conditions, Privacy Policy and E-Consent, and am providing written consent under the FCRA for Loanza partners to obtain consumer report information from my credit profile. I authorize Loanza to share my information with lenders and, but not limited to other marketing partners. I give express written consent to receive recurring marketing and promotional messages from them and Loanza, including email, text messages (SMS/MMS) and calls made using autodialers, artificial or prerecorded messages on my mobile phone or landline regarding my request and related services. I understand that my consent applies to these text messages and telemarketing calls even if I have subscribed to a federal or state “Do Not Call” list. Message and data rates may apply.
